Rules of the raffle

Promotion carried out by TELECYL, S.A. (hereinafter “THEGETAWINE”) that will raffle 10 bottles of wine among the people who buy an experience on the website www.thegetawine.com from December 14 to 24, 2023 included.
1. Prize
The object of the raffle will be 10 bottles of wine with prices between 10 and 40€; according to the terms and conditions established in these rules.
The prize is personal and non-transferable, and cannot be exchanged for its cash value. The winner will receive an email notifying him/her of the prize the same day of the drawing.
In the event that the winner cannot be located within 10 days, or the prize is expressly refused for any reason, the prize will be forfeited.
2. Participants
All persons residing in Spain, who make a purchase of an experience through the website Thegetawine from December 14 to December 24, 2023 inclusive, and who expressly accept their participation, except for the excluded persons indicated in clause 6 of these terms and conditions.
Participation in the raffle is free of charge.
3. Date of the draw
The purchase period will be from December 14 to December 24, 2023, both inclusive.
The rules will be published on the website www.thegetawine.com and two drawings will be held:

- December 26, 2023 with a maximum of 10 winners.

- January 8, 2024 with a maximum of 9 winners.
The winners of the first drawing will be excluded from the drawing on the 8th beforehand.
The draw will be conducted through the platform https://app-sorteos.com/es.
At the end of each drawing, the winner will be informed by e-mail.
4. Mechanics of the raffle
STEP 1:
Only one participation per purchase is possible.
In the event that the purchase is cancelled prior to either of the two drawings, the participant will be excluded.
STEP 2:
Drawings will be held on December 26, 2023 and January 8, 2024 and winners will be notified by email.
5. Tax Withholding
Participants are informed that this prize in kind will be subject to current tax legislation.
If, according to current legislation, it is mandatory to make the corresponding deposit on account of the prize awarded, THEGETAWINE will be responsible for the same income, and at the time will issue the appropriate certification to facilitate the participant’s compliance with their tax obligations.
The completion of the personal and fiscal data of the winners necessary for the delivery of the prizes is mandatory, so that the absence of any of these data will result in the loss of the right obtained.
6. Exclusions
Purchases that are not paid correctly or that are cancelled before the date of the sweepstakes in accordance with the provisions of these terms and conditions and persons who do not expressly accept their participation will not be entered into the sweepstakes that is the object of this promotion.
Participants who provide the wrong e-mail address will also be excluded.
THEGETAWINE is not responsible for erroneous or false data expressed by the participants, being the draw void in the event that it would be impossible to contact the winner as a result of the inaccuracy of any of the data provided.
Likewise, all minors under 18 years of age are expressly excluded from participating in this Promotion.
7. Personal data
You hereby agree that the personal data included in the purchase of your experience on the website www.thegetawine.com will be used for the purpose of managing your participation in the sweepstakes and the communication of the corresponding prizes, if applicable.
Responsible: The personal data you provide will be processed by TELECYL, S.A, with CIF A- 47310941 and address at Calle Enrique Cubero 9, Edificio Madison Arena 47014 (Valladolid).
Purpose: We will process your personal data in order to carry out this sweepstakes and communicate the prize to the winners.
Legitimation: The legal basis for the processing of your personal data is consent.
Recipients: Your personal data will not be disclosed to third parties nor will international transfers be made, except to the platform where the sweepstakes will be held, https://app-sorteos.com/es.
Rights: Remember that you can exercise your rights of access, rectification, deletion, as well as other rights under the applicable regulations on Data Protection, at the following email address: dpo@madisonmk.com including in the subject “Thegetawine Christmas Sweepstakes”.
8. Exemption from liability
THEGETAWINE is not responsible for:
a) The tax implications that the participation in the promotion may have for the participants in the promotion.
b) The use of the promotional gift by the Winner.
c) Defects in the promotional gift, except for those caused by the postal delivery.
d) The conditions and term of delivery of the gift.

10. Applicable Law and Jurisdiction
The rules of the sweepstakes are governed, with waiver of any other jurisdiction that may correspond to them, to the jurisdiction of the Courts and Tribunals of the city of Valladolid for the resolution of any dispute that may arise from the interpretation and / or compliance with them.
11. Other considerations
THEGETAWINE reserves the right to modify the terms and conditions of the sweepstakes at any time, including cancelling or terminating the sweepstakes. In any case, it undertakes to publish the modification of the rules on the website so that all participants may have access to such information.
12. Acceptance
Participation in this sweepstakes implies prior and unconditional acceptance of the sweepstakes rules.
